Sheriff's Department to Resume Application of Time Credits for County Inmates

On February 16, 2010, a Sacramento County Superior Court judge vacated his earlier order and dissolved the temporary restraining order which prohibited the Sacramento County Sheriff’s Department from applying a recent amendment to penal code section 4019, Time Credit for Work and Good Behavior, to county jail inmates.

After consultation with County Counsel, the District Attorney’s Office, and Attorney General Brown, effective immediately, the Sheriff’s Department will be applying the time credits prospectively. In compliance with amended penal code section 4019, after January 25, 2010, eligible county jail inmates will accrue one-for-one credit for work and good behavior.

Releases of inmates, eligible under the newly amended section, will occur as the new calculations are applied. All notifications to local law enforcement agencies have been made regarding the pending releases.

On February 8, 2010, at 1:16 a.m., Sacramento County Sheriff’s deputies responded to a home in the 7800 block of Winding Way regarding the report of a shooting. Deputies arrived and found a 31-year-old male victim inside the home. He had suffered a gunshot wound to his lower body. A second 25-year-old male victim was also found at the scene. He had suffered an injury to his forehead. Both victims were transported to a local hospital. The 31-year-old victim was later pronounced dead at approximately 5:00 a.m. The second victim was released from the hospital after receiving treatment for his injury.
